Governors’ Immunity Shields Them from Parliamentary Summons – Lawmaker

Igariweh Enwo, the representative of Afikpo North/Afikpo South Federal Constituency, has stated that the immunity granted to governors prevents the National Assembly from summoning them for civil or criminal proceedings while they remain in office.

Speaking to reporters in Abuja on Wednesday, Enwo revealed that he had recently presented a petition in the House of Representatives. The petition involved the Governor of Ebonyi State, Chief Nwifuru, and the Police in an alleged case of abduction and illegal detention of Ohanaeze Youth President, Igboayaka Igboayaka.

However, Enwo admitted that the petition was not properly submitted, citing a constitutional restriction.

he stated:”Under Section 308(1) of the Nigerian Constitution, certain government officials, including governors, are granted immunity from legal proceedings while in office. This immunity clause means the House of Representatives has no jurisdiction to hear the petition or summon the governor.”

Enwo urged fellow lawmakers to ensure their legislative actions align with constitutional provisions. He also expressed confidence in Nigeria’s growing democracy and reaffirmed his commitment to the rule of law, highlighting his efforts in delivering democratic dividends to his constituents.
