Ebonyi High Court Discharges Final 24 Biafran Detainees After Four-Year Legal Battle

In a landmark judgment, the Ebonyi State High Court has discharged and acquitted the last 24 Biafran activists held in detention since May 24, 2020, over allegations of conspiracy and treason.

Presided over by Justice I.P. Chima, the court ruled in favour of a preliminary objection raised by the defence counsel, which argued that the accused had previously been acquitted of similar charges by multiple courts and, under the Nigerian Constitution, could not be prosecuted again on the same grounds.

Citing Section 36(9) of the 1999 Constitution (as amended)—which prohibits double jeopardy—the court described the continued trial as unconstitutional and ordered the immediate release of the detainees.

The lead defence counsel, , representing the Indigenous People of Biafra (IPOB), hailed the verdict as a major victory for human rights and judicial integrity.

“This judgment is a beacon of hope,” Ejiofor stated. “These individuals were subjected to prolonged incarceration under recycled allegations despite being cleared by at least five different High Courts within Ebonyi.”

He applauded Justice Chima for delivering what he called a courageous and intellectually sound ruling, which, according to him, restores faith in the judiciary as the last refuge of the oppressed.

Ejiofor also expressed appreciation to the Ebonyi State legal authorities and correctional services for their willingness to comply with the court’s directive. He further called on the state government to support the reintegration of the released individuals through rehabilitation and compensation programs, citing the emotional and financial burdens borne by their families.

“Though delayed, justice has finally prevailed. These four years have been agonizing, but today, freedom has triumphed,” he added.

The ruling brings an end to a long-running legal saga that had drawn criticism from civil society groups and human rights organizations, many of whom condemned the repeated detention and prosecution of the activists on identical charges.
